In January 2018, new California contracts fall under amended California Civil Code Section 2782.8 as a result of legislation enacted in 2017 known as SB 496.
This joint program of ACEC CA Bay Bridge and SEAONC features insurance and risk specialist to help identify strategies for your firm.
Brett Stewart, J.D., Risk Manager, AXA XL Design Professional. He is responsible for developing risk management and education materials for AXA XL’s architect and engineer insureds with the goals of minimizing the frequency and severity of loss exposures, while focusing on increasing best practices. Brett interfaces directly with brokers and other valued business partners, the public and various trade organizations in an effort to promote issues that are relevant to the design community. Prior to his role as Risk Manager, he was a Senior Claims Specialist handling design professional claims for seven years. He is a licensed California attorney and was a litigator at two San Francisco law firms for eight years.
Mike Olson, Vice President, Dealey, Renton & Associates, Design Professional Practice Group. Mike’s role at Dealey Renton is the client executive for many of the company’s key client relationships. In addition to insurance placement and consulting, Mike spends his time involved in industry issues related to insurance and risk management. He is a member of the ACEC National Risk Management Committee and prior to assisting ACEC California’s legislative efforts on Senate Bill 496 worked with ACEC Washington in 2012 on legislation limiting the defense obligation of design professionals in the State of Washington. Mike is a native of Portland, Oregon and currently resides in Orinda, California.
D. Creighton Sebra, J.D., Clark Hill, PLC. D. Creighton Sebra has extensive litigation experience in the representation of clients in federal and state trial courts. Creighton worked for both a civil engineering contractor and a general building contractor as a project manager as well as a project estimator. This experience within the construction industry, combined with his experience litigating breach of contract matters and construction disputes, allows Creighton to provide invaluable service and expertise in the representation of his clients.

Speakers:
Ellen Smith has been with BART for 25 years and is BART’s Project Manager for the New Transbay Rail Crossing. BART is partnering with the Capitol Corridor Joint Powers Authority (CCJPA) to lead this multi-billion dollar project. Ellen has worked on the SFO Extension and the 10-mile eBART extension from Pittsburg-Bay Point to Antioch. She is a planner with a Masters in Urban and Regional Planning from USC.
Rob Padgette has more than 20 years of transportation experience in both the public and private sector. He joined CCJPA in 2018 where he serves as the Deputy Managing Director. Prior to joining CCJPA, Rob worked for the Northeast Corridor Commission where he worked with Amtrak, USDOT, and states along the Corridor to develop a coordinated approach to passenger rail. He also served as APTA’s Policy Director from 2007-2010. Rob holds a Masters in Urban Planning and a Bachelors in Political Science from UNC.
